2. what data do we collect and process and from what sources do we obtain it?

We only collect and process the following personal data relevant to our services:

3. for what purpose and on what legal basis do we process your data?

We process your data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG n.F.).

Your personal data is collected and processed in order to establish our own contractual relationship between you and us. The legal basis for this is Art. 6 para. 1 lit. b GDPR.

If you wish to be informed about the business activities of our company, we process your personal data (name, telephone number, e-mail address, address, customer number) for advertising and information purposes. This personal data is processed on the basis of your consent. The legal basis for this is Art. 6 para. 1 lit. a GDPR.

Insofar as the processing of personal data is necessary to fulfill a legal obligation, in particular a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR as the legal basis.

If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR as the legal basis for processing (e.g. defense in legal disputes, enforcement of claims, etc.).

4. who will have access to your data?

Within our company, access to your data is granted to those employees who need it to fulfill our contractual obligations, i.e. who are entrusted with the contractual processing.

We pass on your data to recipients outside our company (in this case Biopract GmbH) exclusively for the fulfillment of our contractual obligations within the scope of our business purpose.

5. for how long will your data be stored?

Your data will only be processed and stored for as long as it is necessary for the processing purpose defined under 3. Insofar as legal requirements exist, these apply.

The prescribed periods for storage and documentation are 5 years (HGB), 6 years (AO) or 10 years (HGB), depending on the document and legal regulation.

6. what data protection rights are you entitled to?

Every data subject has the right of access (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), the right to restrict processing (Art. 18 GDPR), the right to erasure (Art. 17 GDPR), the right to object (Art. 21 GDPR) and the right to data portability (Art. 20 GDPR). The right to information and erasure is subject to the restrictions of Sections 34 and 35 BDSG.

If the data processing is based on consent, you can revoke this consent at any time with effect for the future. The data processing carried out up to the time of revocation remains lawful.

7. am I obliged to provide my data?

In order to enter into a business relationship and to perform and fulfill contractual obligations, it is necessary for you to provide us with the personal data required for this purpose. Furthermore, the obligation to collect data may be prescribed by law. If you do not provide this data, it will not be possible to conclude or execute the contract.

1. Objection in individual cases

For reasons that may arise from your particular situation, you have the right to object at any time to the processing of personal data concerning you on the basis of Art. 6 para. 1 e) GDPR (data processing in the public interest) and Art. 6 para. 1 f) GDPR (data processing based on legitimate interests).

If an objection has been lodged, your personal data will no longer be processed unless there are demonstrably compelling reasons that outweigh your interests, rights and freedoms. Further processing is also possible if the processing serves the assertion, exercise or defense of legal claims.

2. objection to direct advertising

Your personal data may be processed for direct marketing purposes. You have the right to object to such processing at any time. This also applies to profiling insofar as it is associated with direct advertising.
